Termination

Energiebewegung may suspend or terminate your account and or your right to utilize the services made available through this website in the event that it determines or has reasonable grounds to suspect that you are in violation of the Terms and Conditions.

Notwithstanding any of these Site Terms that may suggest otherwise, Energiebewegung reserves the right, without notice and in its sole discretion, to terminate your right to use this website for any reason or no reason at all, and to block or prevent future access to and use of this website by you. In the event your right to use this website is terminated, these Site Terms will still apply. Furthermore, any breach of these Terms and Conditions by you may result in your being blocked from the website and without refund of any paid amounts.

Warranty

At Energiebewegung we constantly strive to send out good energy and high-quality products. We warrant all items sold on this website to be free from defects and in good order for thirty (30) days after the buyer accepts delivery. Please choose wisely, as we do not issue replacements, exchanges, returns, or refunds for a change of mind. The following details pertain to our warranties on defective items.

1.0 The user is aware that many of the goods shipped by Energiebewegung are hand-made pieces of art containing natural products. As such, natural color, pattern, or slight size deviations may occur. These do not entitle the buyer to warranty claims.

2.0 The proof that the defect in the item was present at the buyer’s acceptance of said item is incumbent on the user.

3.0 Insofar as there was a defect for which Energiebewegung was responsible when the buyer accepts the item, Energiebewegung will remedy the defect at its own discretion by rectification or replacement. Conversion is excluded.

4.0 Buyer has the obligation to inspect the delivered item as soon as possible and notify Energiebewegung in writing of any defects detected. Otherwise, the item(s) will be deemed to be without defect and accepted as such by the buyer. If the buyer does not notify Energiebewegung of a defect by e-mail within five (5) days of delivery, the item(s) shall in any case be deemed to have been approved and accepted by the buyer.

5.0 Any damage to delivered item(s) caused by the transport company must be communicated to the delivery service immediately and compensation sought through the delivery company.

6.0 Concerning handmade works of art, the warranty period is thirty (30) days from the buyer’s acceptance of the item(s). Concerning e-books, meditation recordings, and other materials delivered through the internet, the warranty period is thirty (30) days.

7.0 Should any defect be found that has been caused by Energiebewegung, and the buyer notifies Energiebewegung within the previously mentioned time period, Energiebewegung will either replace the item or process a refund to the buyer at Energiebewegung’s discretion.

Limitation of Liability

Energiebewegung and its Affiliates do not accept liability beyond the remedies set forth herein or in the Warranty Statement or initial offer to sell. This includes, without limitation, any liability for products not being available for use or for lost or corrupted files in the case of downloads. Energiebewegung and its Affiliates shall not be liable for misuse of materials, negligence on the part of the buyer, the buyer buying and/or using item(s) for any purpose other than their intended use.

All “Art” sold through this website is just art and has no magic or scientific powers or abilities and Energiebewegung and its Affiliates shall not be liable for the buyer(s) purchasing art for purposes other than the enjoyment and visual admiration of the art and/or art objects. Some of the art is intended to be used while meditating and the art remains just art.

Under no circumstances will buyer(s) purchase item(s) through this website as a substitute for medical treatment. If you are physically or mentally ill, see your medical practitioner. Items available through this website ARE NOT TO BE SUBSTITUTED FOR MEDICAL CARE. Energiebewegung and its Affiliates do not accept liability for the buyer(s) belief in conspiracy theories, lack of common sense, avoidance of proper medical care, or plain stupidity.

Some art items are small and the Buyer assumes all liability for protecting small children and animals from eating small pieces of art and choking hazards.

In any event, Energiebewegung and its Affiliates will not be liable for any “damages” beyond the price of the item(s) purchased through this site.

Energiebewegung and its Affiliates operate through this website in good faith, do our best to ensure quality products for our buyers, and the foregoing limitations apply regardless of the causes or circumstances giving rise to such loss, damage, or liability. Even if such loss, damage, or liability is based on negligence or other torts or breach of contract including, without limitation, a fundamental breach or breach of a fundamental term.

Trademarks, Intellectual Property, and Copyrights

Recordings, videos, art, and other items available through this website are intended for single end-user use. Buyer(s) agree not to copy, reproduce, sell, exploit, re-package, re-sell, republish, post on other websites (without the expressed, written permission of Energiebewegung and/or its Affiliates) any material from this website and Buyer(s) will be liable for criminal prosecution under German and EU laws for reproducing and selling items from this website or violating any item mentioned in this section.

Energiebewegung and its Affiliates hold and reserve all logos, names, designs, scripts, text, trademarks, recordings (audio & video) as their property. The purchase by Buyer of items through this website does not convey title or ownership to Buyer, but instead gives Buyer only the limited rights set forth herein, that is; to have, use, admire and appreciate items purchased through this website.

Ownership and exclusive use of all logos, names, designs, scripts, trademarks, recordings (audio & video), and all other items that pass through this website is held and remains with Energiebewegung and its Affiliates, alone.

Payment

All prices and Euro amounts on this website are in German Euros. Energiebewegung and its Affiliates presently accept the following credit cards; VISA, MasterCard, American Express, and Discover. We reserve the right to stop accepting credit cards from one or more issuers.

Energiebewegung and its Affiliates will accept SEPA Bank Transfers as payment.

Energiebewegung and its Affiliates accept PayPal as an acceptable form of payment.

Energiebewegung and its Affiliates will not, under any circumstances, accept personal checks as payment.

In order for Buyer to pay with a credit card, and to purchase items through this website, Buyer will provide Energiebewegung (and keep on our file) a valid, authentic, and current credit card, which Buyer is authorized to use. By submitting a credit card number to Energiebewegung, Buyer is representing and warranting that the credit card information Buyer provides is valid, authentic, current, and one that Buyer is authorized to use. Buyer agrees that in the event the credit card information Buyer has provided becomes invalid, out of date, or that Buyer is no longer authorized to use the card, Buyer will immediately provide another credit card number that is valid, authentic, and current, which Buyer is authorized to use. Some electronic transactions may require extended processing in addition to credit card authorization, Buyer will be notified by an Energiebewegung customer service representative if extended processing is required to complete Buyer’s transaction request through our website. This may affect the estimated delivery date, as nothing (no item) will be shipped until full payment has been received and verified by Energiebewegung and its Affiliates. All products and services must be paid for at the time of the order. If a charge against a credit card Buyer has provided is not authorized or accepted, or is subsequently refused or rejected, Energiebewegung and its Affiliates reserve the right to cancel Buyer’s order without notice or liability.
